Xactly Incent UI Refresh Raffle Terms and Conditions

  1. Participants must fully complete each of the qualifying requirements listed below in order to remain eligible to win the Xactly UI Refresh Raffle (“Promotion”). Failure to complete any one of the eligibility requirements below will result in immediate disqualification from participation in the Promotion, the offer immediately becoming null and void with respect to that participant, and the participant otherwise forfeiting any and all rights to participate in the Promotion and in and to any Promotion prize. To remain eligible, participant’s must:
    1. Be an administrator of Xactly software for a current Xactly Corporation (“Xactly”) customer
    2. Turn on Refresh in Incent by:
      1. Logging into their Xactly Incent account
      2. Clicking on the Account Menu icon
      3. Toggling on “Use Incent Refresh Pages”
    3. Be an individual who is over the age of 18.
  2. Participant understands and acknowledges that all reviews submitted as a part of the Promotion are public. Participant acknowledges and agrees that Participant will otherwise comply with all applicable terms and conditions with Xactly when using Xactly Incent.
  3. Limited to one entry per individual
  4. Eligibility will be as solely determined by Xactly in its absolute discretion.
  5. The Promotion starts on 12/04/2022 at 11:59pm PT and ends at 1/31/2023 at 11:59pm PT (“Promotion Period”). Entries submitted outside of the Promotion Period will not be eligible for the Promotion.
  6. The Promotion and related prizes cannot be:
    1. exchanged, transferred, converted, redeemed for any other offer including a cash value offer;
    2. transferred to any other party
    3. used combination with any other promotional offer, pricing or discounting.
  7. After the expiration of the Promotion Period, Xactly will randomly draw one (1) winner for a $175 Amazon gift card from the pool of eligible Promotion submissions.
  8. Prize winners will be notified via email on or before 2/10/2023. If a prize winner does not claim the prize by 2/24/2023 that prize winner will immediately forfeit their right to the prize and a new prize winner will be randomly selected.
  9. Xactly is not responsible for any taxes on the prizes, and winners acknowledge and agree to be liable for any such taxes on the prizes.
  10. No mechanically reproduced, incomplete, forged, software-generated or automated multiple entries will be accepted.
  11. Xactly assumes no liability, and shall not be liable, for typographical or other errors in this offer or administration of the Promotion including, without limitation, errors in the printing or display of theprize selection, notification and announcement of the winner, or distribution of theprize. Xactly is not responsible for any incorrect or inaccurate information, whether caused by participants, internet users or by any of the equipment or programming associated with or utilized in the Promotion.
  12. Participant’s agree that Xactly and its affiliates, and their officers, employees, agents and representatives shall not be responsible for any losses, damages or injuries of any kind resulting from participation in the giveaway or from participants’ acceptance, receipt, possession and/or use or misuse of any prize.
  13. All issues and questions concerning the construction, validity, interpretation and enforceability of these rules shall be governed and construed in accordance with the internal laws of the State of California without regard to the choice of law provisions thereof.
